Adobe's changes to its terms of service have sparked a storm of outrage on social media, as creatives publicly protest against Adobe having full access to their work.

Adobe recently updated its terms of service to clarify that it may access user content automatically and manually “using techniques such as machine learning.”

The company can use, reproduce or “create derivative works” of its users' content using Adobe products like Photoshop and Illustrator. According to Apple Insider, it can also view subscriber content even if the user is subject to a nondisclosure agreement, effectively violating the nondisclosure agreement.

The wording of the new terms also gives Adobe the opportunity to use content created by subscribers – even content protected by nondisclosure agreements – to train its AI image generator, Firefly.

In a post on X published on Wednesday that has been liked over 71,000 times and viewed by more than 9.5 million people, creative concept artist Sam Santala criticized Adobe for its new terms and conditions.

“So am I reading this correctly?” Santala wrote. “I can't use Photoshop unless I agree to give you full access to everything I create with it, INCLUDING NDA work?”

Santala noted that if he doesn't agree to the terms, he won't be able to talk to Adobe's support chat, uninstall Photoshop, or even log in and cancel his subscription.

Santala's post was one of many. Other creatives, from toy designers to film directors, also publicly criticized Adobe's new terms and conditions.

Scott Belsky, Adobe's Chief Product Officer for Adobe Creative Cloud, responded to Santala's post, stating, “Adobe does NOT train GenAI models on customer content, and we obviously have strong safeguards in place for any form of access to customer content.”

Adobe Creative Cloud has an estimated 33 million subscribers.
